Infringement Notice
Assessment instruments, scoring programs, test booklets, answer sheets, and other related materials sold and distributed by Pearson's Clinical Assessment group are the proprietary property of NCS Pearson and/or its licensors and suppliers and contain copyrighted works and trademarks owned by NCS Pearson and/or its licensors. The unauthorized reproduction of copyrighted test items, scoring keys (including scoring algorithms, scale definitions, scale membership, and scoring directions), normative data, test booklets, answer sheets, profile forms, and other related materials without the permission of NCS Pearson is a violation of copyright law.

Payment
Pearson Canada Assessment Inc. accepts payment by cheque, money order, or Visa, MasterCard or American Express credit cards. All invoices are payable net 30 days. Prepayment is required for all new accounts. Charges not paid when due are subject to a late charge accruing from the due date of 1.5% per month or the maximum permitted by law, whichever is less. The Purchaser is responsible for any attorney's or collection fees incurred by Pearson Canada Assessment Inc. in collecting charges not paid when due. Payment must be made in Canadian dollars. Pearson Canada Assessment Inc. will collect and report federal and provincial taxes applicable to the customer's shipping address. If your account is not currently listed as "tax exempt", applicable federal and provincial taxes will be added to your invoice. If you wish to be listed as "tax exempt" for future purchases, please send a copy of your tax exempt certificate to Customer Service.
Shipping and Handling
Test materials are shipped by traceable means via ground delivery unless first class, air, or special delivery is requested. Orders that include a specific delivery date will be treated as authorizing air or special delivery charges if accelerated shipping (or delivery) is needed to meet the required date. A minimal handling charge will be added to orders for materials to cover picking, packing, and assembly costs. In addition, shipping charges will be added. Together, these charges will be listed on your invoice as "Shipping and Handling." Usually, orders of in-stock items are processed and shipped within 24 to 72 hours. Please contact Customer Service for more information on and verification of your specific shipping timelines.
Expedited Delivery
Customer Service must receive orders by noon Eastern Standard Time for Expedited Delivery.
Backorders
We make every attempt to maintain sufficient inventory to handle all routine orders without backorders.
If a backorder occurs and you desire partial shipment or would prefer that we hold your order until it can be filled in its entirety, please let us know.
Confirming Orders
If an order is placed by phone or fax and followed up with a confirming purchase order, please make certain that it is clearly marked as CONFIRMING. This will prevent a duplicate shipment.
Volume Discounts on Materials
Customers may obtain volume discounts on their total orders. If any materials are returned, the order will be rebilled at the applicable price.

For private practitioners, Pearson Canada Assessment Inc. offers 10% off orders of $5000 or more. Quantity discounts do not apply to combination kits or other types of discounts, including pre-publication offers or conference discounts. To take advantage of the volume discount, product requests have to be submitted on one purchase order and the order has to be shipped to one address.
University Alliance Program
A special training program with unique discounts is granted on the purchase of test materials for the teaching needs of college and university faculty and training directors. The UAP applies to accredited degree-granting academic training settings and university-based clinics in Canada only. Practicum and internship settings are not eligible for the UAP. Return Policy
Pearson Canada Assessment Inc. guarantees satisfaction with the quality of its test materials. If for any reason you are unhappy with one of our products, simply return it in saleable condition within 60 days of purchase for a full credit or refund, whichever is preferred. The 60-day satisfaction guarantee applies to all materials, except for books, software and videos where a 30-day return timeframe applies. If your shipment of materials is defective, damaged, or incomplete, it may be returned for exchange or credit within 60 days of the invoice date. Items in saleable condition returned after 60 days will not be accepted for credit or refund unless pre-authorized by Pearson Canada Assessment Inc. Pre-authorized returns are subject to a restocking fee. Please contact Customer Service at 1-866-335-8418 to receive an authorization number. Shipping charges for returns are the responsibility of the customer. We recommend that you return the package insured and via a traceable carrier (e.g., FedEx or UPS) as Pearson Canada Assessment Inc. will not issue credit for products that do not arrive at our office. Software Usage and Return Policy
All of Pearson Canada Assessment Inc.'s software licenses are sold on a per user basis and each license may be installed and used by one user only (unless otherwise noted).
Software may be returned within 30 days of invoice date, including all media, accompanying materials and original packaging along with a written statement verifying that the software has been removed from all computers. Software returned after 30 days will not be accepted for credit or refund unless pre-authorized by Pearson Canada Assessment Inc. Please contact Customer Service at 1-866-335-8418 to receive an authorization number.

Acceptance of Terms and Conditions
Sales of test instruments, related materials, and services are based upon acceptance of the various terms and conditions and adherence to all policies described in this catalogue. Purchasers agree to be bound to all terms and conditions by placing an order for materials, signing Pearson Canada Assessment Inc.'s Customer Registration Form, a Purchase Order, a Test Order Form, or by part or total payment of Pearson Canada Assessment Inc.'s invoice for any tests, materials, or services ordered. No modification or additions to these terms and conditions are binding upon Pearson Canada Assessment Inc. unless previously agreed to in writing by an authorized representative of Pearson Canada Assessment Inc.
Terms and Conditions of Purchase
- Limited Warranty. Pearson Canada Assessment Inc. warrants that its products meet applicable professional standards and will be manufactured in usable quality. Pearson Canada Assessment Inc. makes no other warranties, expressed or implied, including warranties of merchantability or fitness for a particular purpose. Replacement of materials, or refund of all or a portion of the purchase price (based upon the salable condition of the materials), at Pearson Canada Assessment Inc.'s sole option and in accordance with the product return policy constitutes the purchaser's sole and exclusive remedy, in lieu of all remedies and actual, consequential, special, incidental, or other damages in connection with the product and any use or misuse thereof. Pearson Canada Assessment Inc. will not, under any circumstances, be liable for purchaser's expense for delays, for costs of substitute materials, or for possible lost income, grants, profits, or any other special or consequential damages that may result from using a product. Some jurisdictions restrict certain limitation of warranties, so some or all of the above limitations may not apply to you.
- Confidentiality. Purchaser acknowledges and agrees the contents of Pearson Canada Assessment Inc.'s tests may constitute trade secrets, which include confidential and proprietary material, information, and procedures. Purchaser will not resell or otherwise distribute materials, or authorize or allow disclosure of the contents of a test instrument protocol, including test questions and answers, or normative data, except under the limited circumstances described in the section titled "Maintenance of Test Security," or as otherwise contemplated in the manual associated with the test. Purchaser acknowledges and agrees that the use or disclosure of trade secrets in a manner inconsistent with the provisions of this Agreement may cause Pearson Canada Assessment Inc. irreparable damage for which remedies other than injunctive relief may be inadequate. Accordingly, you agree that in any request by Pearson Canada Assessment Inc. to a court of competent jurisdiction for injunctive or other equitable relief seeking to restrain such use or disclosure, you will not maintain that such remedy is not appropriate under the circumstances.
- Maintenance of Test Security. Each person or institution purchasing a test must agree to comply with basic principles of minimum test security, including the standards described in "Maintenance of Test Security and Test Use."
- Copyright Notice. Tests, test protocols, test items, norms, score reports, and other related materials of Pearson Canada Assessment Inc. are copyrighted. They are not to be reproduced or transmitted in any form or by any means, electronic or mechanical, including photocopying, recording, or any information storage and retrieval system without permission in writing from Pearson Canada Assessment Inc. The reproduction of any part of Pearson Canada Assessment Inc.'s copyrighted tests and related materials in any way, whether the reproductions are sold or furnished free for use, is a violation of federal copyright law. No adaptations, translations, modifications, or special versions may be made without permission in writing from Pearson Canada Assessment Inc.; users are advised that such adaptations, translations, modifications, or special versions may affect the validity of the tests.
- Protective Orders. Purchaser agrees to seek a protective order safeguarding the confidentiality of test materials classified by Pearson Canada Assessment Inc. as C-level assessments if Purchaser is required to produce such materials in court or administrative proceedings.
- Limitation of Liability. IN NO EVENT WILL PEARSON CANADA ASSESSMENT INC. BE LIABLE FOR DAMAGES ARISING UNDER THIS AGREEMENT, OR OTHERWISE ARISING FROM THE ORDER(S) CONTEMPLATED UNDER THIS AGREEMENT, IN EXCESS OF THE AMOUNTS PAID FOR THE PRODUCT(S) WHICH DIRECTLY CAUSED THE DAMAGE.
- Notices. Any required notices shall be given in writing to the Purchaser at the most recent contact information provided by Purchaser to Pearson Canada Assessment Inc. We may send you notice by electronic mail as an alternative to conventional mail.
Permissions and Licensing Policy
Reproduction of any purchased materials requires the prior written consent of Pearson Canada Assessment Inc. Questions and answers, including practice questions and answers, may not be reproduced without written permission, regardless of the number of lines or items involved. Test copies may not be bound in theses or reports placed in libraries, generally circulated, or accessible to the public, or in any article or text of any kind.
Pearson Canada Assessment Inc. will consider requests for permission to reproduce, modify, or translate part or all of any copyrighted publication and will also consider the granting of licenses for use of our copyrighted materials. Requests to reproduce, translate, adapt, modify, or make special versions of these publications should be addressed to:

Permission to Use Copyrighted Test Norms
Pearson Canada Assessment Inc. has the sole right to authorize reproductions of any portion of its published tests, including test norms. Copying of test norms without authorization is a violation of copyright. The term "copying" includes, but is not limited to, entry of test norms into a computer memory for purposes of test processing, scoring, or reporting. Any person or organization wanting to use Pearson Canada Assessment Inc.'s test norms must submit a formal written request to the Legal Department. If permission is granted, a fee may be charged. Permission from Pearson Canada Assessment Inc. for use of test norms does not imply endorsement of, or responsibility for, the accuracy or adequacy of any test processing, scoring, or reporting service.
Permission for Research
Permission is not needed for research by individuals who are qualified to purchase and administer the tests; however, no reproduction of test materials is allowed for any purpose, including articles and reports based on research, without the prior written consent of Pearson Canada Assessment Inc. Students wanting to use test materials for thesis, dissertation, or research should complete and submit a Student Qualifications Form located at www.PsychCorp.ca.

Maintenance of Test Security and Test Use
Each person or institution purchasing a test must agree to comply with these basic principles of minimum test security:
- Test takers must not receive test answers before beginning the test.
- Test questions are not to be reproduced or paraphrased in any way.
- Access to test materials must be limited to qualified persons with a responsible, professional interest who agree to safeguard their use.
- Test materials and scores may be released only to persons qualified to interpret and use them properly.
- If a test taker or the parent of a child who has taken a test wishes to examine test responses or results, the parent or test taker may be permitted to review the test and the test answers in the presence of a representative of the school, college, or institution that administered the test. Such review should not be permitted in those jurisdictions where applicable laws require the institution to provide a photocopy of the test subsequent to review. If you are not certain of the effect of the laws in your province, please contact your province's professional organization.
- No reproduction of test materials is allowed in any form or by any means, electronic or mechanical.

- Test materials may not be resold or distributed for any purpose.
Rules Governing Sale of Materials to Various Categories of Purchasers
Universities, schools, organizations, businesses, clinics, and hospitals are subject to the guidelines set forth above and must have appropriately qualified individuals on staff in order to purchase test materials. These individuals must complete a Customer Registration Form or provide information as to their qualifications. Orders not accompanied by this documentation may not be processed.
Qualified customers should comply with the requirements of their respective institutions concerning the use of purchase orders. Pearson Canada Assessment Inc. may not be able to process orders without the appropriate purchase order(s) or other documentation required by the institution.
No educational materials will be shipped to a home address. If you are a homeschooler, please contact Customer Service for advice. There are homeschool agencies that provide testing services in programs approved by Pearson Canada Assessment Inc.
Note: The Stanford Achievement Test Series, Metropolitan Achievement Tests, Aprenda, New Standards, and Otis Lennon School Ability Tests will be sold to schools and school districts only.
PIPEDA
The Canadian Psychological Association (CPA) and leading Canadian test developers, including Pearson Canada Assessment Inc., believe that Test Record Forms or Protocols may not be disseminated to persons who claim that they are entitled to copies under the Personal Information Protection and Electronic Documents Act (PIPEDA). It is Pearson Canada Assessment Inc.'s position along with CPA and other leading test developers that test items are trade secrets and that such information is not required to be disclosed under PIPEDA. Pearson Canada Assessment Inc. has claimed trade secret status for its test record forms and protocols for many years in order to preserve the validity of these tools used by the professional community for the benefit of the general public.
